A woman from Sverdlovsk successfully sued the organizer of self-improvement courses for lack of results.
In Yekaterinburg, a court denied a woman compensation for unsuccessful self-development courses. This was reported by the press service of the courts of Sverdlovsk Region.
As follows from the case materials, in March last year a city resident concluded a contract with individual entrepreneur Aleksey Mezentsev to take the program “Money and Personal Brand.” The cost of the course was 80,000 rubles. After completing the training the woman was dissatisfied with the result and demanded a refund.
Not receiving compensation, she filed a suit in the Verkh-Isetsky District Court, seeking to recover from the entrepreneur 80,000 rubles for poor-quality services, another 80,000 rubles in penalties, 50,000 rubles in compensation for moral damage, and a fine for refusing to voluntarily satisfy the consumer’s demands.
The court of first instance sided with the plaintiff: it found that the entrepreneur had not provided the client with the full course program prior to signing the contract, thereby violating her consumer rights. As a result, Mezentsev was ordered to pay 80,000 rubles in principal debt, 30,000 rubles in penalties, 5,000 rubles in compensation for moral damage, and a 57,500-ruble fine.
However, the entrepreneur appealed. After reconsidering the case, the regional court overturned the decision of the court of first instance. The judges found that the contractual obligations had been fully performed: the client was given access to all lessons, added to the training chats, her homework was checked, and online consultations were held.
“The plaintiff terminated the contract only after completing the course in full. No improper provision of services or incomplete performance was established,” the court decision reads.
Thus, the regional court held that dissatisfaction with the outcome of the training does not mean poor quality of the service. Final decision — the woman’s claims were definitively dismissed.
