A woman from Sverdlovsk who worked at a Wildberries pickup point won a court ruling recognizing her as its employee.

A resident of Nizhny Tagil won a court ruling recognizing her as an employee of Wildberries and the related labor rights. In addition, the court ordered payment of the compensations required by law.

The lawsuit to protect labor rights was heard by the Tagilstroevsky District Court of Nizhny Tagil. The plaintiff, Olga A., worked for a long time as a customer relations manager at a Wildberries pickup point, and later, after the merger of the two companies (Wildberries and outdoor advertising operator Russ), at LLC "RVB".

Her relationship with the employer was formalized through civil-law contracts. This deprived the woman from Sverdlovsk of social guarantees as an employee. The defendants named in the suit were LLC "Wildberries" and LLC "RVB".

Company representatives did not appear in court, but the court, by default judgment, granted the claim in full. In particular, it ordered the defendants to formalize employment relations with the plaintiff in accordance with the law and to make entries in her employment record book about the periods of work, to provide all necessary information to the Social Fund of Russia and to make insurance contributions for the employee.

In addition, the plaintiff was awarded: 111,697 rubles as compensation for unused vacation, 60,838 rubles as compensation for delayed payments, and 20,000 rubles as compensation for moral harm.

The court found that Olga was, in fact, an employed worker: she followed an established schedule, was subordinate to staff employees, used the employer’s equipment and had access to the company’s internal resources. She received wages on a par with colleagues who worked under employment contracts.

The court’s decision may be appealed within the time limits prescribed by law.
