In the Sverdlovsk region, a donkey caused a traffic accident.
The Sverdlovsk Regional Court upheld the decision regarding an unusual traffic accident that occurred on the Lesozavod - Ivdel highway. The owners of the donkey were ordered to pay the motorist nearly 66,000 rubles for the damaged foreign car.
The accident happened in May of last year. A Mazda 3 collided with a donkey that was roaming freely on the road. According to the driver, upon noticing the animal on the roadway, he reduced his speed to nearly the minimum, but was unable to avoid the collision. The donkey suddenly jumped onto the right side of the car, damaging the front fender, door, and side mirror, after which it calmly continued on its way.
The damage to the car was estimated at 74,500 rubles. The car owner filed a lawsuit against the animal's owners in the Ivdel City Court.
The defendants insisted in court that their guilt was not proven and that the accident occurred due to the motorist's own negligence. However, the court established that the donkey's owner violated animal care rules: early in the morning, he tied the donkey near the road and left it unattended.
At the same time, the court acknowledged that the driver also partially violated traffic rules. As a result, the degree of responsibility was distributed in a 90 to 10 ratio.
An auto-technical examination confirmed that the car's damages were indeed caused by contact with a large animal.
In the end, the court partially satisfied the claim and ordered the donkey's owners to pay 65,979 rubles. An attempt to appeal the decision was unsuccessful—the Sverdlovsk Regional Court deemed the conclusions of the first instance lawful. The decision has come into effect.
