The court has frozen another construction project in Yekaterinburg in the Botany area.
The Arbitration Court of the Sverdlovsk Region has imposed a temporary ban on construction work in Yekaterinburg opposite the Botanical Garden of the Ural Branch of the Russian Academy of Sciences, at the intersection of 8 Marta and Julius Fuchik streets, reports the EAN agency.
All work on the site must be frozen, according to materials from the registry of the Seventeenth Arbitration Court of Appeal. It is assumed that the developer LLC "Botanika" (formerly JSC "Invest-Stroy") planned to build a parking lot in this location, writes EAN.
The court proceedings began in June at the request of the Sverdlovsk Region Prosecutor's Office. The supervisory authority appealed to the Arbitration Court of the Sverdlovsk Region with a demand to recognize the lease agreement for the land plot, concluded between JSC "Invest-Stroy" and MUGISO back in 2016, as invalid and to terminate it. Subsequently, several additional agreements were added to the contract in 2020, 2023, and 2025.
"To apply the consequences of the invalidity of a null transaction, imposing on LLC 'Botanika' the obligation to return the land plot to the Ministry of Property Management of the Sverdlovsk Region. To prohibit LLC 'Botanika' from carrying out any activities on the land plot (construction, placement of structures, and others)," the Sverdlovsk prosecutor's demand states.
In addition, the prosecutor's office requested that interim measures be applied to the defendant during the proceedings. However, this request was rejected by the court.
In June, residents of the "Botanika Green House" residential complex in the Botanical microdistrict managed to achieve the cancellation of the construction of a residential high-rise building near the Botanical Garden of the Ural Branch of the Russian Academy of Sciences. The developer, part of the Baden Family, intended to build another 34-story building in the densely populated area of Botanika, thereby blocking the green recreational area for residents who had previously purchased apartments with beautiful views. To do this, one construction company acquired from another the plot that had been promised to residents as a place for guest parking.
