In Yekaterinburg, a caregiver from an elite kindergarten fell on a 2-year-old boy.
A woman from Yekaterinburg accused a kindergarten teacher of breaking her child’s head. Ksenia began taking her 2-year-old son to the private kindergarten "Sunbeam" in August. During all five days that her son attended the institution, he was picked up with bruises, and the last time the child suffered a head injury.
"I brought my son at 8:30, and at 8:52 the accident had already happened. My son was walking a little ahead of the caregiver, holding her hand; she got distracted, tripped over my boy, fell onto her knee and onto the child. He fell and hit the back of his head on the asphalt, another caregiver grabbed him and ran into the kindergarten building," the young mother told portal E1.RU.
She was not informed about what had happened. At 12:00, when the Yekaterinburg woman came to pick him up, he had an abrasion under his eye — the staff said he had been fighting with someone.
"I took my son to his grandmother's, he fell asleep — and when he woke up, his grandmother saw a huge bruise on the back of his head," Ksenia added.
The mother immediately contacted the caregiver. She confirmed the fall and noted that she had applied ice to the child's head. Fortunately, there was no concussion.
The woman does not understand why the kindergarten did not call an ambulance or at least take him to a local doctor. In addition, after the incident she was returned 76,000 rubles — payment for attendance (a month costs 50,000) and moral compensation estimated at 35,000.
But Ksenia said she will demand 1.2 million rubles from the kindergarten, and will also appeal to the Investigative Committee, the prosecutor's office and other authorities.
A representative of the "Sunbeam" kindergarten, lawyer Elena Volnenko, commented on the incident as follows:
"The child was returning from a walk at 8:53. Three caregivers were walking with the group; the child was being held by the hand. He suddenly crouched down a little; the caregiver lost her balance and they fell. The caregiver put her arm under the boy, he was picked up and examined, the child did not cry, there were no signs of injury, and everyone went back into the kindergarten. That same day there was a second walk, everything was fine. The boy had no bruises, no one applied ice to him. Since he had not been injured, the caregiver did not contact the parents or medical staff. When the mother picked up her son — the boy was not crying, there were no bruises on his head. Given his light and thin hair, the scalp is clearly visible. Five hours later the mother began calling with complaints. All this time the child was under the supervision of his relatives, and nobody knows where they walked or how everything happened," Elena Volnenko explained to E1.RU.
The fact that the child sustained injuries during the walk has not been proven, and the mother's pretrial claim was answered with compensation and a full refund.
The amount of compensation was determined taking into account existing case law on minor bodily harm. In addition, Ksenia provided a single medical certificate with the diagnosis "hematoma"; there was no concussion, and the degree of harm was determined on the basis of that document.
