Russians who install an air conditioner in their apartment may face a fine.
Residents of apartment buildings may face a fine of up to 2500 rubles for the illegal installation of air conditioners. This was reported by RIA Novosti, citing a member of the OP RF commission for public expertise of legislative bills and other regulatory acts, Yevgeny Masharov.
According to the Housing Code of the Russian Federation, the facade of the building is common property of the homeowners. Therefore, changes related to the facade must be approved at a general meeting of the apartment owners, the RIA Novosti interlocutor explained.
"Article 7.21 of the Administrative Offenses Code of the Russian Federation (violation of the rules for using residential premises - ed.) establishes liability for citizens for the illegal installation of air conditioners in residential buildings in the form of a fine from 2000 rubles to 2500 rubles," Masharov said.
The expert also noted that the permissible noise level in residential premises is no more than 50 dBA during the day and 45 dBA at night. Exceeding these indicators, including due to the operation of the air conditioner, may expose citizens to administrative liability in the form of a fine from 500 to 1000 rubles.
In cases where the air conditioner was installed in violation of requirements or disturbs neighbors, the apartment owner may be required to dismantle the outdoor unit of the split system and carry out restoration work on the facade, lawyers interviewed by RIA Real Estate previously reported.
Installing an air conditioner on a cultural heritage site without approval may result in a fine ranging from 15,000 rubles to 200,000 rubles.
"If the building is classified as a cultural heritage site, it will not be possible to install an air conditioner on the facade of such a building. The prohibition is enshrined in Article 47.3 of Federal Law No. 73-FZ 'On Cultural Heritage (Historical and Cultural Monuments) of the Peoples of the Russian Federation,'" the expert stated.
