In Nizhny Tagil, a 74-year-old pensioner attempted to reclaim her apartment through the court, which she sold in February of last year to the daughter of a participant in the special military operation (SMO). This was reported by the prosecutor's office of the Sverdlovsk region.
The prosecutor's office, based on part 3 of article 45 of the Civil Procedure Code of the Russian Federation, participated in the consideration of the civil claim of a resident of Nizhny Tagil born in 1952 regarding the recognition of the apartment sale agreement as invalid (and the application of the consequences of the invalidity of the transaction).
During the court session, it was established that the apartment sale agreement was concluded in February 2025 between the plaintiff and the daughter of the participant in the special military operation (SMO).
The buyer transferred the funds and received the keys to the apartment, pays utility bills, but has not been able to move in and use the housing until now.
The plaintiff—the woman who sold her the apartment—stated that she was under the influence of fraudsters, and the funds received from the transaction were transferred to the accounts of unknown individuals.
During the court session, the prosecutor concluded that there were no grounds for satisfying the claims, including due to the lack of evidence of any influence on the plaintiff by fraudsters during the transaction.
Taking into account the prosecutor's position, the Leninsky District Court of Nizhny Tagil ruled to deny the plaintiff's claims. The ownership rights to the housing remain with the family members of the participant in the special military operation. The court ruling has not yet entered into legal force.
A criminal case has been initiated regarding the fraudulent actions against the pensioner by the OP No. 17 of the Ministry of Internal Affairs "Nizhny Tagil" under part 4 of article 159 of the Criminal Code of the Russian Federation (fraud). The individuals involved in the crime have not yet been identified.
