In the Sverdlovsk region, the mother of six children was deprived of benefits for her son who died in the special military operation.
In the Sverdlovsk region, a court proceeding concluded with a decision in favor of the sister of a deceased participant of the Special Military Operation (SMO), who sought recognition as the de facto guardian of her brother. This allowed her to obtain the right to the corresponding payments, which had previously been designated for the soldier's mother.
According to the case materials, the mother of the deceased soldier led an asocial lifestyle, abused alcohol, and did not take care of her children. A total of six children were raised in the family, and the woman had previously been deprived of parental rights concerning the two eldest. It was also established that in 1999 she was convicted of murder and sentenced to imprisonment, but was later released under amnesty.
According to the Sverdlovsk Regional Court, after finishing the 7th grade, the brother moved in with his sister, who effectively took on his upbringing and support. The mother, as noted in the case materials, did not participate in his life and did not provide financial support.
Initially, the court granted the sister's claim and recognized her as the de facto guardian of the deceased. The mother attempted to challenge the decision in the appellate court and then in the cassation court, insisting on the lack of evidence of her neglect of parental duties.
However, the courts indicated that the case materials also lacked evidence of her proper fulfillment of parental responsibilities. As a result, all previously made decisions were left unchanged, and the right to receive payments was secured for the sister of the deceased soldier.
Earlier, the court recognized the grandfather of the deceased participant of the SMO as the de facto guardian and deprived the mother and widow of the payments.
