"Flowers from Alla" wanted to sue the Yekaterinburg city hall for causing moral harm.
Representatives of the organization that owns the "Flowers from Alla" pavilion, which is being demolished by the administration of Yekaterinburg, have disseminated through the media a ruling from the investigator regarding the initiation of a criminal case for violating the rights of the kiosk owner.
The ruling from the senior investigator of the investigative department for the Lenin district of Yekaterinburg was sent to the 66.RU portal by representatives of the owner organization "Alla-T," Denis Gataullin. It states that "unidentified officials" significantly violated the rights and legal interests of the owner, causing moral harm to Denis Gataullin. The investigator ruled to recognize him as a victim in the criminal case.
The authenticity of the ruling has not been confirmed by the regional Investigative Committee, but it has not been denied either, reports 66.RU. However, the city administration expressed doubts about the document's authenticity against the backdrop of two court rulings in favor of the city hall.
In February, investigators from the Lenin district did indeed initiate a criminal case regarding the negligence of city hall employees, but this ruling was overturned by the deputy district prosecutor, 66.RU reminds. The owners of the pavilion did not have documents confirming their ownership rights.
The owners refused to demolish the pavilion located near the governor's residence on their own, so, as stated by the city hall, the object will be demolished by the city after May 20. The owners have one last hope—the cassation court, to which they have filed a complaint.
