In Tyumen a surrogate mother refused to hand over the fifth child to the biological parents from Yekaterinburg. This was reported to URA.RU by the lawyer of one of the parties to the dispute, who wished to remain anonymous.
"A client came to me. For six years she has been a surrogate mother, helping families who cannot have children for medical reasons. Four children were successfully handed over; they are being raised in good families. However, complications arose with the last one — the fifth fetus. It is developing with abnormalities, and there is a risk the child will be born with health problems. In connection with this, the surrogate mother wants to terminate the contract and keep the baby with her," the lawyer said.
Despite the identified fetal pathologies, the biological parents from Yekaterinburg are demanding the transfer of the child and are ready to increase the monetary compensation to the surrogate mother. The lawyer notes that case law on such matters is extremely limited.
A lawsuit has already been filed in the Yekaterinburg District Court, where it is being heard in closed proceedings.
"It is hard to assess the surrogate mother's chances of winning at this stage," the lawyer admitted. "There is a precedent when the well-known lawyer Dobrovinsky succeeded in ensuring that a child remained with the surrogate mother. We hope for a similar outcome in this case."
According to the lawyer, grounds for a court decision in favor of the surrogate mother could include information about possible mental or physical problems of the child identified before birth.
According to the latest information, the biological parents from Yekaterinburg are prepared to pay the Tyumen surrogate mother 12 million rubles. Initially, a contract for 9 million rubles had been concluded between the surrogate mother and the biological parents.
