A resident of Sverdlovsk won a lawsuit for her sister's apartment, which the sister had gifted to a neighbor before her death.
A resident of Sukhoi Log returned her deceased sister's apartment, which had been gifted to a neighbor, through the court. Experts concluded that at the time of signing the gift agreement, the woman did not understand what she was doing. This was reported by the unified press service of the courts of the Sverdlovsk region.
The sister of the plaintiff, a disabled person since childhood who suffered from mental disorders, passed away in 2025. After her death, the sister discovered that the apartment where the deceased lived had been gifted to a neighbor back in 2023. The sister believed that the neighbor had taken advantage of the donor's helpless state and deceitfully persuaded her to make the deal.
During the proceedings, the court appointed a posthumous forensic psychiatric examination. Experts concluded that at the time of signing the gift agreement, the woman could not understand the significance of her actions and could not control them.
As a result, the Sukhozhsky City Court declared the gift agreement invalid and applied the consequences of the invalidity of the transaction: the defendant's ownership rights to the apartment were terminated, and the housing was returned to the inheritance mass.
The court was guided by paragraph 1 of Article 177 of the Civil Code of the Russian Federation, according to which a transaction made by a citizen who is unable to understand the significance of their actions or control them may be declared invalid at the request of that citizen or other persons whose rights have been violated.
The court's decision has not yet entered into legal force and may be appealed.
