The court in Krasnoufimsk ordered the seller to transfer the apartment to the buyer, despite the history with the fraudsters.
Sverdlovsk resident Andrey bought 1/2 of a house and a share of the land for 4 million rubles in June 2025. According to the contract, the property was to be transferred by July 1. However, the former owner, pensioner Olga, refused to vacate, claiming she had become a victim of fraudsters.
Andrey went to court demanding the eviction of the woman and the transfer of the keys to him. In response, Olga filed a counterclaim asking to recognize the transaction as invalid.
As it turned out in court, after the sale, the pensioner almost immediately transferred the received money—about 3.95 million rubles—to unknown individuals. Later, a criminal case was opened for fraud, and the woman was recognized as a victim.
Olga claimed that she acted under pressure from the criminals: they convinced her that the transaction was fictitious and would help "save" the property. She also insisted that she sold the house for less than the market price.
The buyer disagreed with this. He explained that he found the advertisement, inspected the house, negotiated the price, and the seller explained the urgency due to moving to her daughter. The transaction took place at a notary, and the money was transferred officially.
The court appointed two expert examinations to check the woman's condition. Both showed that she understood what she was doing and could manage her actions, although she was gullible.
In the end, the court decided that the transaction was legal: the parties voluntarily signed the contract, and the buyer was unaware of the fraudsters and acted in good faith. The seller's mistakes in motives do not constitute grounds for canceling the transaction.
The court sided with the buyer: it recognized that the former owner no longer had the right to live in the apartment, ordered her eviction, and mandated the transfer of the keys and the code to the lock.
