In Nizhny Tagil, a former employee of the State Traffic Safety Inspectorate has been found guilty of the illegal transfer of personal data, reports the press service of the courts of the Sverdlovsk region in Makh.
The defendant, Nikolai Abarenov, held the position of inspector in the administrative law enforcement group of the separate battalion of the State Traffic Safety Inspectorate of the Ministry of Internal Affairs of Russia "Nizhnetagilskoye." Last year, on a July night, he received a message via messenger from an acquaintance who asked him to find information about the owner of a car using the state registration number.
According to the woman, the driver had created an emergency situation on the road, but a collision was avoided.
"Nikolai agreed to help. The next day, he used an open account of a colleague in the traffic police database and obtained confidential data: full name, date of birth, address, phone number, photo of the driver's license, and information about fines. He sent the data to his acquaintance via messenger. Abarenov knew that such information was intended for official use only and was not subject to disclosure," the press service of the regional courts reported.
The owner of the car involved in the "incident" was also a woman. Nikolai's acquaintance contacted her with complaints about her driving style, after which she reported it to the police.
The defendant admitted his guilt and apologized to the victim, as well as took measures to atone for his wrongdoing by partially compensating her for moral damages in the amount of 20,000 rubles.
Abarenov was found guilty under paragraph "g" of part 3 of article 272.1 of the Criminal Code of the Russian Federation ("Illegal transfer of computer information containing personal data obtained through unauthorized access to the means of its processing, storage, committed using his official position").
The Tagilstroevsky District Court of Nizhny Tagil, when determining the sentence, took into account that the defendant had never had problems with the law before, actively cooperated with the investigation, and had minor children dependent on him. His financial situation was also considered.
He was sentenced to a fine of 200,000 rubles and a 2-year ban on holding positions related to the functions of a representative of the authorities in the law enforcement system. In addition, the defendant was ordered to pay 50,000 rubles in compensation for moral damages to the victim. The court's verdict has not yet entered into legal force and may be appealed by the parties within 15 days.
