Residents of the high-rise building in "Akadem" have won ownership of the gas boiler house.
In Yekaterinburg, the court recognized the gas boiler house as common shared property of the residents, reports the unified press service of the courts of the Sverdlovsk region. Previously, the facility was privately owned by two individuals.
The owners of the apartments in the multi-apartment building at Chkalova Street, 252 appealed to the Academic District Court of Yekaterinburg with a lawsuit against two defendants who owned equal shares of the gas boiler house at Chkalova Street, 252 "b", which provides heating and hot water to this building.
The plaintiffs demanded recognition of their right to common shared ownership of this facility, while seeking to terminate the defendants' rights.
Citing the Housing Code of the Russian Federation, the plaintiffs insisted that under the law such property is common to all residents. Moreover, the boiler house exclusively serves their building.
The court, having reviewed the case materials on April 27 and heard the parties, agreed with this position and sided with the residents, recognizing the gas boiler house as their common property.
The claim was fully satisfied. The common shared ownership of the residents over the gas boiler house was recognized, and the registration of the defendants' ownership rights was deemed absent. The decision has not yet come into force and may be appealed by the parties.
