The court made an unexpected decision to order the mass demolition of kiosks in Yekaterinburg.

A Chelyabinsk court ruled illegal the document that led to the mass demolition of kiosks in Yekaterinburg. On September 23, the Seventh Cassation Court of General Jurisdiction decided that a decree of the government of Sverdlovsk Region had unlawfully shortened the renewal term for agreements to place kiosks to two years.

As a result, because of the decree the renewal term for most kiosks expired in 2025. After that the Yekaterinburg city administration began demolishing the stalls en masse. Now the court has ruled that the term was set illegally.

Konstantin Akatyev, a lawyer for the Association of Small-Format Trade Enterprises, said there had been a federal recommendation to extend the contracts for placing kiosks by seven years. Now the authorities need to create a new regulatory framework for extensions, and all kiosks whose contracts have not been terminated will remain in place.

“How long is for the regional authorities to decide, but an extension will have to be made,” E1.RU quotes Akatyev.

Even kiosks that have already been demolished can return to their previous locations if their owners have not terminated the contracts.

The Telegram channel “Yekaterinburg. Main” reported that it is unlikely the kiosks will return.

“Formally, the Chelyabinsk court’s decision (the instance that preserves the status quo) annuls not only the possibility of taking any actions regarding NTOs, but also the very document on the basis of which traders could keep their objects,” the Telegram channel “Yekaterinburg. Main” writes.

Earlier, the Yekaterinburg prosecutor’s office reported that the mass demolition of kiosks in the city was unfounded.
